 We provide competitive fees for the immigration services at Kilic & Kilic Solicitors. We provide hourly rates as well as estimated fees. Our estimated immigration prices are as follows:

Our costs are based on competitive market pricing as well as an approximation of the time it will take to conclude your matter from beginning to end. The above fees are our estimated fees for an average matter of this nature. On a complex matter which needs a tailored quote, our fees would be calculated at a rate of £150 plus VAT per hour for the work of Paralegals and £250 plus VAT for the work of Solicitors.

What our service includes:

We offer a professional service with competitive fees and flexible payment terms for all of our clients. If our clients cannot afford to pay our fee in full at the time of the instructions, we are happy to accept half of the agreed fee at the time of initial instructions and the balance to be paid before an application is submitted to the Home Office. Our estimated fees cover all work relating to your matter including;

  • Taking initial instructions;
  • Providing advice on documentation needed for your type of application;
  • Checking the supporting documents for the application/appeal;
  • Preparing the necessary application/appeal forms and cover letters on your behalf;
  • Preparing grounds of appeal;
  • Preparing representations in support of your application if required;
  • Sending the application form, representations and supporting evidence to the Home Office;
  • Representing the client at the Tribunal hearings/Appeal hearings;
  • All communication between the Home Office and other agencies concerning your application/appeal until a decision is made on your matter;
  • Advising on any action to be taken once a decision is made.

What we charge:

In addition to the above average estimated fees, we also offer work on hourly rates. Our hourly charging rate is £150 plus VAT for the work of Paralegals and £250 plus VAT for the work of Solicitors.

On average applications of above nature costs between £700 to £1,900 to complete, depending on the number of hours required to deal with your specific issue.

The exact number of hours will depend on the circumstances of your case such as:

  • The amount of supporting evidence that we need to consider;
  • The complexity of your matter;
  • Which language(s) you speak;
  • Whether you are applying for other dependents.

It will be helpful if, at our first meeting, you are able to provide any evidence needed to meet the applicable Immigration Rules. This will help us speed up the process and assist us in keeping costs to the lower end of the range.

Rates and VAT:

Please note that all our above fees are inclusive of VAT. Where VAT applies, we add this to our charges at the prevailing rate. We will confirm whether VAT (at a rate of 20%) is payable on fees when you instruct us and we can work out if VAT is properly chargeable.

Most disbursements attract VAT at the prevailing rate. This will be added to the bills we receive. We pass the total cost on to you. We do not add VAT on to disbursements where VAT has already been added by the relevant third party. Certain disbursements such as official fees are not subject to VAT. Charging VAT in relation to immigration matters can be complex as it may depend on where you live and what immigration permission you have. We will confirm whether VAT is payable once we have been instructed and are in a position to do so.

Disbursements:

Most immigration applications will also be subject to a Home Office application fee and Immigration Health Surcharge, again we will provide you a breakdown of these fees once we are instructed. Clients will be responsible for paying the Home Office fees/appeal fees (HO fees vary depending on the type of the application they are submitting. In circumstances where we need to instruct a Barrister to represent you, we will notify you of your options and the fees of the Barrister. We estimate this will costs between £500-£1,500 plus VAT per hearing, depending on the seniority of the barrister as well as the nature of the hearing.

Most of our fee earners are bilingual, if however you require an interpreter, the costs of this will be in the region of £100-£200, depending on how long the interpreter is required.

There may also be a Court Fee in the sum of £140 and Tribunal Fees in the sum of £154 to be paid on your matter, depending on the type of application made.

 Timescales:

It is difficult to estimate how long it will take before the Home Office can reach a decision on your matter as this will depend on the case and caseworker dealing with the application. We will normally be able to submit this type of application to the Home Office within 4 to 6 weeks of you instructing us, but we will let you know at the earliest opportunity if it is likely to take longer than this.

However, we can only give a rough estimate that most straight forward cases can take between 3 to 6 months for the Home Office to provide a decision, and complicated cases can take between 6 to 12 months for the Home Office to reach a decision. Appeals to the First-tier Tribunal take much longer. You should allow up to a year to complete the appeal. This might increase if the Home Office becomes exceptionally busy, as it is expected as a result of Brexit. You can read the current processing times at https://www.gov.uk/visa-processing-times.

This is an estimate and we will keep you updated on the timescales of your matter on a regular basis.

What our service includes:

No matter whether you are buying or selling a freehold or a leasehold property, the main elements of the work we undertake are the same.

The key stages of a conveyancing matter when you are the seller include:

  • Taking your instructions and giving you initial advice.
  • Reviewing the legal title of the property.
  • Negotiating/drafting/advising on contractual documents and in particular any special conditions.
  • Making/responding to any enquiries about the property.
  • Addressing issues of joint ownership (if applicable).
  • Arranging for exchange of contracts and notifying you when exchange has taken place.
  • Arranging completion and notifying you when completion has taken place.
  • Receiving/sending/distributing completion monies.
  • Dealing with the assignment of the lease (unregistered leasehold properties only).

The key stages of a conveyancing matter when you are the purchaser include:

  • Investigating the title of the property and reviewing the draft documents including protocol forms,
  • Checking the that finances are in place to fund the purchase and corresponding with the lender of their Solicitors (if applicable)
  • Conducting conveyancing searches in relation to the property
  • Approving the draft documents and raising enquiries (if necessary)
  • Advising on the need for legal indemnity insurance (where applicable)
  • Reporting on the mortgage off and any leases.
  • Reporting on the legal title and completing the certificate of title for the lender
  • Obtaining authority to exchange of contracts and setting a completion date
  • Completing the matter
  • Completing and submission of the SDLT Return on your behalf and arranging the payments of any SDLT due.
  • Applying to the Land Registry to register your purchase and mortgage and dealing with any requisitions that they may raise.
  • Providing you with the completion of registration and closing the file.

Tasks included only when you are selling a property:

  • Advising you as you prepare the seller’s property information form and other standard conveyancing forms (where applicable).
  • Obtaining replies to enquiries of the managing agents (leasehold only).
  • Discharging any charges (where applicable).
  • Obtaining the landlord’s licence to assign (leasehold only).
  • Transferring any share in a freehold company or a management company to the buyer.

 What we charge:

In addition to the above average estimated fee range, we also offer work on hourly rates. Our hourly charging rate is £150 plus VAT for the work of Paralegals and £250 plus VAT for the work of Solicitors. All rates depend on the seniority of the individual and the practice area. In some limited cases and on request, we may offer to work on a fixed-fee basis. In these exceptional cases, fees are discussed and agreed before we start work.

We offer a bespoke service and each matter is unique. We can only estimate the likely costs of our conveyancing services once we have discussed the matter with you and seen the papers. However, we can provide an indication of our likely fees associated with the work of varying complexity.

  • Low complexity – from £750 to £1,500
  • Mid complexity – from £1,500 to £3,000
  • High complexity – in excess of £5,000

The following factors (and possibly others) will increase the complexity of the matter:

  • A higher property value.
  • A shorter transaction timetable.
  • Problems with the title of the property.
  • The complexity of the title (e.g. composite titles, separate titles and unregistered titles).
  • A lack of building regulations or planning consent.
  • Delays to the intended transaction timetable.
  • The number of unforeseen complications that arise
  • If the property is a recently built or renovated.
  • The complexity of your financing arrangements.
  • A higher number of buyers/sellers.
  • A chain of dependent transactions.

Rates and VAT:

Where VAT applies, we add this to our charges at the prevailing rate. Unless otherwise specified, all figures are quoted exclusive of VAT. Most disbursements attract VAT at the prevailing rate. This will be added to the bills we receive. We pass the total cost on to you. We do not add VAT on to disbursements where VAT has already been added by the relevant third party.

We will confirm whether VAT is payable once we have been instructed and are in a position to do so.

Disbursements:

In addition to our fees, you will need to budget for the following disbursements:

  2. Search fees (buyer only) £400–£700

  4. Energy Performance Certificates (EPC) £100-£300
  5. Instructing a surveyor, environmental auditor and valuer as appropriate (from £1,000 to £3,000)
  6. Any indemnity policies required (from £50 to £3,000)
  7. Any fees and penalties for redemption to be charged by your bank (these vary widely, but apply only to mortgage-funded purchases)
  8. Selling agents’ fees or buying agents’ fees (in the region of £1,000 to 5% of the property’s value)
  9. Mortgage brokers’ fees (in the region of £1,000 to 2.5% of the sum borrowed).
  10. Management (Resale) Pack (Leaseholds only)-£120-500
  11. Notice fees £60-£150
  12. Certificate of Compliance £120-£250
  13. Deed of Covenant Fee £120-£250

We incur these and other necessary additional third-party costs (‘disbursements’) on your behalf. We would usually discuss disbursements with you in advance and incur them on your behalf when appropriate. You are responsible for all disbursements; we add them to your bill without mark-up. You do not need to pay these third parties directly. You simply pay our bill and we will pass on the relevant sum on your behalf to the relevant third party in settlement of their fees.

This list is not exhaustive and other disbursements may apply depending on the property. For example, certain leasehold properties can only be transferred with the consent of the landlord, for which they and their lawyers will charge a fee. The lease may require other fees to be paid to the landlord (e.g. when notifying a charge) or to the property’s management company (e.g. when entering into a required Deed of Covenant). The level of such fees varies considerably (though often in the range of £100 to £2,500). We will let you know once we have received and reviewed the relevant lease if further fees apply.

You should also be aware that ground rent and service charge are likely to apply throughout your ownership of any leasehold property. We will confirm the ground rent and the anticipated service charge as soon as we receive this information.

Stamp Duty Land Tax:

Unless relevant reliefs apply and dependent on the purchase price of the property, purchasers must pay Stamp Duty Land Tax on the purchase. You can estimate the amount of Stamp Duty Land Tax you will need to pay by using HMRC’s website (https://www.tax.service.gov.uk/calculate-stamp-duty-land-tax/#/intro). This calculator does not cater for all types of purchase. Additionally, sellers may be liable for Capital Gains Tax (further details which are available here (https://www.tax.service.gov.uk/calculate-your-capital-gains/resident/properties/disposal-date?_ga=2.65944812.351805380.1629932897-323130121.1617027387).

Timescales:

The transfer of a property in a low-complexity matter usually takes between six to twelve weeks from receipt of instructions from you. We often act for clients who prefer a shorter timetable. We do what we can, but it is not always possible to progress matters more quickly and typically any transaction involves others who will respond according to their own timetable.

If your property is part of a ‘chain’, then your transaction will only move at the pace of the slowest member of the chain. Where the property is a leasehold property that requires an extension of the lease, this can take between four to six months (and sometimes longer), or where obtaining landlord’s consent is required this can take between six to eight weeks (and sometimes longer). We will be able to give you a better estimate when we know the nature of the transaction you wish to undertake.

There is no upper limit as to how long the matter might take as it can only complete once the buyer and the seller agree and that is not within our control.
